Second Covered List China Mobile Telecom Kaspersky
The FCC’s Public Safety and Homeland Security Bureau adds Kaspersky-branded information-security products and specified China Mobile and China Telecom services to the Communications Act Section 2 Covered List, including the named entities’ subsidiaries and affiliates.
What it does The Public Notice explains that the Bureau identified one Department of Homeland Security determination and two Team Telecom determinations satisfying the Secure and Trusted Communications Networks Act and FCC rules. It adds information security products, solutions, and services supplied directly or indirectly by AO Kaspersky Lab and its corporate family; international telecommunications services provided by China Mobile International USA Inc. subject to Section 214; and telecommunications services provided by China Telecom (Americas) Corp. subject to Section 214. The Appendix also reproduces the previously listed Huawei, ZTE, Hytera, Hikvision, and Dahua categories.
Who it affects The additions apply to providers and users of the covered equipment or services, including subsidiaries and affiliates of the named companies. They reflect DHS’s 2017 Binding Operational Directive concerning Kaspersky products and Team Telecom findings about China Mobile and China Telecom services.
Why it matters The notice implements the FCC’s mandatory Covered List maintenance process. Once an enumerated national-security source determines that equipment or services pose, and are capable of posing, an unacceptable national-security risk, the FCC incorporates that determination into the list.
